Regulamin / Rules of Service

This is an English-language draft regulamin published to satisfy UŚUDE Art. 8 (the obligation to make rules of service available in a form that allows storage). The Polish-language authoritative version will be published once reviewed and translated by Polish counsel. Where Polish-law terminology is used in this draft (e.g., regulamin, UPK, UŚUDE), it is intentional and should be preserved in translation.

1. General Provisions / Postanowienia ogólne

This regulamin sets out the rules for the provision of electronic services in the meaning of Art. 8 of the Act of 18 July 2002 on the Provision of Electronic Services (Ustawa o świadczeniu usług drogą elektroniczną, "UŚUDE"), and the rules of contracts concluded at a distance with consumers in the meaning of the Act of 30 May 2014 on Consumer Rights (Ustawa o prawach konsumenta, "UPK").

Service / Usługa: the "My Evening" iOS application and associated backend services for evening journaling (gratitude, tomorrow planning, breathing exercises, optional voice transcription and AI-assisted person detection), and this website at myevening.app.

2. Definitions / Definicje

  • Consumer / Konsument: a natural person performing a legal act with the service provider not directly related to that person's economic or professional activity (UPK Art. 221 of the Civil Code).
  • User / Użytkownik: a natural person using the service, whether a Consumer or not.
  • App Store: Apple Inc.'s digital distribution platform for iOS apps. Apple is the merchant of record for purchases.
  • Subscription / Subskrypcja: a paid auto-renewing subscription to the service, sold via the App Store.
  • Digital content / Treść cyfrowa: data produced and supplied in digital form (UPK Art. 2 pt. 5).

3. Conclusion of Contract / Zawarcie umowy

A contract for the provision of services is concluded between the User and the service provider when the User installs the iOS app on their device and accepts the Apple App Store terms. A subscription contract is concluded when the User completes a purchase through Apple's StoreKit purchase sheet.

Apple Distribution International Ltd. (Cork, Ireland) acts as the merchant of record for App Store purchases by EEA-resident consumers and collects local consumer VAT.

4. Subscriptions / Subskrypcje

The service is offered with a 7-day free trial. After the trial:

  • Monthly subscription: $2.99 USD per month (or local equivalent set by Apple's pricing matrix).
  • Annual subscription: $29.99 USD per year.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period via the App Store's Subscriptions screen. Renewal is charged to the User's Apple ID. The User can cancel at any time; cancellation takes effect at the end of the current billing period.

5. Right of Withdrawal / Prawo odstąpienia od umowy

Consumers ordinarily have the right to withdraw from a distance contract within 14 days without giving a reason (UPK Art. 27).

Digital-content exception — UPK Art. 38(1)(13) / Directive 2011/83/EU Art. 16(m). The right of withdrawal is excluded for contracts for the supply of digital content not on a tangible medium where performance has begun with the Consumer's express prior consent and acknowledgment that the Consumer thereby loses the right of withdrawal, and the service provider has confirmed those facts on a durable medium.

When you start your subscription, the in-app paywall and the App Store purchase confirmation collectively serve to (a) capture your express consent to immediate performance of the digital content, (b) acknowledge that you thereby lose your right of withdrawal, and (c) provide a durable confirmation (Apple's email purchase receipt). If you did not give such consent, or if you have not yet begun using the digital service, you may use the model withdrawal form.

6. Technical Requirements / Wymagania techniczne

  • Apple iPhone running iOS 18 or later.
  • An Apple ID and acceptance of the Apple App Store terms.
  • An internet connection for sign-in, voice transcription, person detection, and subscription verification. Most journal data is stored on-device.

7. Complaints / Reklamacje

Service complaints (in particular, complaints about defects in the digital content under UPK Chapter 5b — non-conformity of digital content or service) may be submitted by:

A complaint should describe the defect, the User's expectation, and contact details. We will respond within 14 days from receipt; lack of response within that period is treated as acceptance of the complaint (UPK Art. 7a). For payment-related complaints (refunds, billing errors), the User should also follow Apple's refund procedure at reportaproblem.apple.com.

8. Out-of-Court Dispute Resolution / Pozasądowe sposoby rozpatrywania sporów

A Polish-resident Consumer has access to out-of-court dispute resolution mechanisms, including:

  • Permanent consumer courts (stały polubowny sąd konsumencki) at the regional inspectorates of the Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej).
  • Mediation by the regional Trade Inspection inspectorates.
  • Free advice from a county or municipal Consumer Ombudsman (powiatowy/miejski rzecznik konsumentów).
  • The European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

Use of these procedures is voluntary; the service provider is willing to participate where it is possible to reach an amicable solution.

9. Personal Data / Dane osobowe

Processing of personal data is governed by our Privacy Policy. The data controller within the meaning of GDPR Art. 4(7) and RODO is Ivan Sokalskyi (full operator details on the Legal Notice page).

10. Final Provisions / Postanowienia końcowe

This regulamin is governed by Polish law. The choice of Polish law does not deprive a Consumer of the protection of mandatory provisions of the law of the Consumer's country of habitual residence.

For Users who are not Polish-resident Consumers, the master agreement is the English-language Terms of Service; this regulamin and the Terms of Service are intended to be substantively consistent. In case of conflict between the two for a Polish Consumer, the regulamin (and applicable mandatory Polish law) prevails.

The service provider reserves the right to amend this regulamin for valid reasons (changes in the law, changes in the service, changes in providers). Material changes will be notified to active Users at least 14 days in advance via the App or by email where available, and the "Last updated" date above will be bumped.
