Terms of Use (End User License Agreement)

1. The licence that applies to My Evening

My Evening is licensed to you, not sold. The licence is Apple's Licensed Application End User License Agreement (the "Standard EULA"), which you can read in full here:

We do not use a custom licence agreement. Apple maintains the Standard EULA, applies it in every country and region where the App is available, and localises it for each App Store language. This page exists so that the licence terms are always one link away from the App and from this site.

2. How this fits with our other documents

The Standard EULA covers your licence to the software: what you may do with the App on your Apple devices, and the limits Apple places on that use.

Everything else is ours. Your subscription and billing, refunds, your ownership of what you write, our AI features and their limits, acceptable use, our liability, and your consumer rights in the EU/EEA, the UK and Australia are governed by our Terms of Service. How we handle personal data is described in our Privacy Policy, with the current list of third-party providers on our Sub-processors page. Polish-resident consumers also have our Regulamin.

The two sets of terms apply alongside each other. Where they overlap, § 13 of the Terms of Service sets out which one governs which subject matter.

3. Apple's role

This section is a plain-language summary. The binding wording is in § 13 of our Terms of Service and in Apple's Standard EULA itself.

Our Terms of Service record that:

• the agreement for the service is between you and Ivan Sokalskyi (operating as "My Evening"), not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims related to the App
• Apple is a third-party beneficiary of those Terms

Two further points come from Apple's Standard EULA itself, because they are the ones users ask about most often:

• if the App fails to conform to any applicable warranty, Apple's only obligation is to refund the purchase price; any further claim is ours to answer, to the extent the law allows
• you may not use the App if you are located in a country subject to a US Government embargo, or if you are on a US Government list of prohibited or restricted parties

Apple is also the merchant of record for App Store purchases and handles refunds. See § 4 of the Terms of Service.
